United Kingdom (source country)

The copyright notice on the National Portrait Gallery's website constitutes copyfraud since this photograph is currently in the public domain in the United Kingdom pursuant to the provisions of the Copyright, Designs and Patents Act 1988 (c. 48), as amended and in force today.

As a photograph, this work is considered an "artistic work" (S. 4(1)(a)). The 1988 Act states that "copyright [in an artistic work] expires at the end of the period of 70 years from the end of the calendar year in which the work was made" (S. 12(3)(a)). This photograph thus entered the public domain in the United Kingdom on 1 January 2002.

The Act states that an artistic work is protected for 70 years after it is made available to the public if it was so made available within 70 years of its creation. However, this private studio photograph is not known to have ever been published prior to 2002. Its first recorded publication according to the NPG website took place in 2004, i.e. after the 70-year protection period had expired.

Public domain logo This UK artistic work, of which the author is unknown and cannot be ascertained by reasonable enquiry, is in the public domain because it is one of the following:
  • A photograph, which has never previously been made available to the public (e.g. by publication or display at an exhibition) and which was taken before 1st January 1956; or
  • A photograph, which was made available to the public (e.g. by publication or display at an exhibition) before 1 January 1956; or
  • An artistic work other than a photograph (e.g. a painting), which was made available to the public (e.g. by publication or display at an exhibition) before 1 January 1956.

The work is in the public domain in Canada because Canada observes the rule of the shorter term.

Warning sign This tag can be used only when the author cannot be ascertained by reasonable enquiry. If you wish to rely on it, please specify in the image description the research you have carried out to find who the author was.

Warning sign The above is all subject to any overriding Publication right which may exist. In practice, Publication right will often override the first of the bullet points listed.

This tag does not apply to engravings or musical works. Unpublished anonymous paintings remain in copyright until 1 January 2040. More information.

Copyrighted in the U.S. This work is not in the public domain in the United States because its copyright in the U.S. was restored by the URAA as it was still copyrighted in its source country on the URAA date (January 1 1996 in most cases but see Wikipedia:Non-U.S. copyrights for details). In most cases, it is copyrighted in the U.S. until 95 years after the year in which it was initially published (exceptions are works published after 1977; see commons:Commons:Hirtle chart).
