The copyright notice on the National Portrait Gallery's website constitutes copyfraud since this photograph is currently in the public domain in the United Kingdom pursuant to the provisions of the Copyright, Designs and Patents Act 1988 (c. 48), as amended and in force today.

As a photograph, this work is considered an "artistic work" (S. 4(1)(a)). The 1988 Act states that "copyright [in an artistic work] expires at the end of the period of 70 years from the end of the calendar year in which the work was made" (S. 12(3)(a)). This photograph thus entered the public domain in the United Kingdom on 1 January 2002.

The Act states that an artistic work is protected for 70 years after it is made available to the public if it was so made available within 70 years of its creation. However, this private studio photograph is not known to have ever been published prior to 2002. Its first recorded publication according to the NPG website took place in 2004, i.e. after the 70-year protection period had expired.

The work is in the public domain in Canada because Canada observes the rule of the shorter term.
